Child custody and support issues for non-custodial parents

The general role of a parent is understood, but when a divorce occurs, parent might struggle to maintain that role. This is especially true if their parenting time is constrained or limited. In some cases, a non-custodial parent has little access to their child or children. This could lead to additional issues that could seriously impact the parents and children involved. Parents in New Mexico understand the importance of developing a fair and amicable child custody arrangement, but in some situations, custody could affect other divorce issues such as child support.

Due to the large amount of non-custodial parents fallen behind in child support payments in the state of New Mexico, the state recently announced that they are offering an amnesty period that will last until the end of the month. If these parents do not pay the full amount owed by the end of the month, the outstanding arrest warrant will remain. In contrast, if they make the full payment, the warrant will be quashed.

The state stressed that parents need to contribute to the upbringing of their children. Child support payments are essential to the upbringing of their children, and failing to make these payments could negatively impact them. In some matters, a child custody arrangement could play a role in the late or delinquent child support payments. If a parent has no or limited parental rights, they might find it difficult to support a child they cannot spend time with.

Not all custody and support issues are the same, but in matters where a non-custodial parent has limited parenting time but is required to pay monthly support, they might seek modification. Changes to a custody or support arrangement could occur if there is a substantial change in circumstances. Furthermore, if it is in the best interest of the child, courts will often award more visitation or modifications to the agreement.

Following divorce, parents might encounter various family law issues. When it comes to custody or support for their child, parents should handle the issues and disputes appropriately. This will allow them to reach an agreement that will focus on the needs and best interests of everyone involved.
