Helping our service members through the divorce process

The members of our nation’s armed forces endure many stresses and life events that most civilians do not. Nonetheless, service members that are married are likely to deal with the natural ups and down of marriage. Because of that, military members also deal with the emotions and major decisions associated with divorce. However, because of deployment, frequent moves, recurrent separation from family members and military laws, military divorces are often more complex than a civilian divorce.

At Atkinson & Kelsey, P.A., our attorneys assist families in New Mexico with one or both spouses in the armed forces. No matter if the stresses associated with military life triggered dissolution or not, it is important that everyone involved in the process has taken the time to fully understand what it means to go through a divorce. Our experienced attorneys have the resources and skills to aid our clients, and our law firm has helped divorcing military families successfully navigate their actions.

When children are involved in the process, this can make a military divorce more challenging for the parents and the children. Determining child custody can be a unique challenge because most families do not have to accommodate visitation due to deployment, training or other military related travel. It can be emotional and difficult to work through custody issues, especially if parenting time is limited for an active service member.

Military laws also define how military benefits are handled during a divorce. Depending on the length of the marriage and other factors in the marriage, a spouse might be entitled to certain military benefits in the divorce. Our attorneys are well versed with these laws and have helped past clients determine what benefits to seek during dissolution.
